1. Scope
1.1 These General Terms and Conditions (T&Cs) apply to all contracts concluded between consumers and businesses (hereinafter referred to as "customer") and FGS Freizeit-Gastronomie und Sportanlagen VermietungsGesellschaft m.b.H., Heimstraße 15, 3702 Stranzendorf, Austria (hereinafter also referred to as "seller," "we," or "us") via the online shop eurobison.com.
1.2 A consumer, as defined by these T&Cs, is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 A business, as defined by these T&Cs, refers to any natural or legal person or legally recognized partnership acting in the exercise of their trade, business, or self-employed professional activity when concluding a contract with us.
1.4 Any terms and conditions deviating from these T&Cs are not recognized unless we explicitly agree to them in writing.
2. General Information on Offers and Orders
2.1 The presentation of our products (especially meat and sausage products, perishable goods) in the online shop eurobison.com does not constitute a legally binding offer. Instead, it serves as a non-binding invitation for the customer to submit an offer.
2.2 The customer is required to provide truthful and complete information when placing an order or registering. Any changes to this information (e.g., address, email) must be promptly communicated to us if relevant to the order processing (e.g., delivery).
2.3 The customer must ensure that the email address provided is accessible and not blocked by automated filters (e.g., spam filters).
3. Ordering Process and Contract Formation
3.1 The customer can select products from our range and add them to a virtual shopping cart using the "Add to Cart" button. The cart's contents can be reviewed, modified, or removed at any time.
3.2 By clicking the final order confirmation button (e.g., "Place Order" or similar), the customer submits a binding offer to purchase the products in their shopping cart.
3.3 After placing an order, the customer receives an order confirmation email summarizing the order details. This confirmation does not yet constitute acceptance of the contract.
3.4 The contract is only concluded when we explicitly confirm acceptance (e.g., via email), send a shipping confirmation, or dispatch the goods to the customer.
3.5 Contracts may also be concluded via email or telephone, provided both we and the customer agree to this arrangement.
4. Contract Text and Language
4.1 We store the contract text (e.g., order and contract details) and send the customer the order details along with these T&Cs in text form (e.g., via email). Before submitting an order, the customer may print the contract text using their browser’s print function or save it digitally.
4.2 The contract language is German. Contracts can only be concluded in this language.
5. Customer Account
5.1 Customers can choose to create a personal account or place orders as a guest.
5.2 When registering an account, the customer must provide accurate information and update any changes promptly.
5.3 The customer is responsible for keeping their login credentials confidential and must not share them with third parties. If unauthorized access is suspected, the customer must notify us immediately.
5.4 The customer is liable for any actions taken using their login credentials unless they can prove they are not responsible for unauthorized access.
6. Pricing and Shipping Costs
6.1 All prices are stated in euros (EUR) and include the statutory VAT applicable in Austria, unless otherwise specified.
6.2 Shipping costs, if applicable, will be clearly stated during checkout and must be paid by the customer unless free shipping has been agreed upon.
6.3 Additional duties or fees may apply to deliveries outside Austria (especially to Germany), which must be covered by the customer if applicable.
7. Payment Methods and Conditions
7.1 We offer various payment options during the checkout process (e.g., bank transfer, credit card, PayPal, Klarna). Available methods will be displayed in the online shop.
7.2 Payments made via third-party providers (e.g., PayPal, Klarna, credit card providers) are subject to the terms and privacy policies of the respective payment provider.
7.3 For credit card payments, the card is charged after verification and authorization.
7.4 If the customer defaults on payment, we reserve the right to charge statutory late payment interest.
